The Application Process
The applicant must pay an underwriting insurability search fee or submit a comprehensive freedom to operate opinion and/or non-infringement opinion from outside legal council that occurred within six months of applying for coverage. The organization must also provide detailed material about the products, services or processes requiring coverage.
The same process applies when a customer decides to add additional coverage including multi-peril coverage and endorsements, when a policy is active. Like the original policy, there may be a 90-day exclusion period.
Infringement threats will be covered during the policy period. However, if legal infringement activity occurred unknown to the applicant, coverage depends on the circumstances. Calculations to determine damage are determined retrospectively from the date infringement activity began, but not when the threat of infringement was made or at the policy purchase date.
The Cost of Coverage
As with any insurance product, premiums are based on several factors. Pricing depends on variables such as the value of products and/or services, industry, case history, financial standing and appropriate risk management litigation prevention strategies.
The policyholder’s co-payment is 20 percent when it can demonstrate that a minimum of 2.5 percent of claim limits will remain available. Higher co-payments encourage lower premiums.
